1. Acceptance & eligibility

By using the Platform you confirm that you are at least 18 years old and able to enter into a binding contract, or that you are using the Platform under the supervision of a parent or legal guardian who agrees to these Terms. You agree to use the Platform only for lawful purposes and in line with these Terms and all applicable laws.

2. About Eddy Trip

The Platform is operated by EDDYTRIP TRADING SERVICE COMPANY LIMITED (CÔNG TY TNHH THƯƠNG MẠI DỊCH VỤ EDDYTRIP) (“Eddy Trip”, “we”, “us”), business registration number 1702361400, registered at Tổ khu phố Cửa Lấp, Phường Dương Tơ, Đặc khu Phú Quốc, Tỉnh An Giang, Việt Nam.

Eddy Trip is a travel-services platform that lets you discover and book travel products and connectivity. For most travel services, we act as an intermediary that enables you to purchase services provided by independent third-party suppliers and operators. For eSIM connectivity, we provide the service together with third-party connectivity partners. Except where we are the direct provider, the supplier is responsible for actually delivering the service to you, and your booking may also be subject to that supplier’s own terms (see Section 8).

3. Your account

You must provide accurate, current, and complete information when registering and keep it up to date. You are responsible for keeping your login credentials confidential and for all activity under your account. Notify us promptly at support@eddytrip.com if you suspect unauthorized use. We may refuse, suspend, or close accounts that breach these Terms or that we reasonably believe are being used unlawfully or fraudulently.

4. Services & availability

Depending on your country and supplier availability, the Platform may offer:

• eSIM connectivity — mobile data and connectivity plans;
• Flights — domestic and international air tickets;
• Vehicle rentals — motorbike and car rentals;
• Daily tours — guided tours and local experiences;
• Attraction tickets — admission to attractions and activities; and
• Airport transfers — point-to-point ground transport.

Our travel services are currently focused on travel to and within Vietnam, and are available to travelers from any country, subject to supplier availability.

5. eSIM terms

• Device compatibility. eSIM requires a compatible, carrier-unlocked device. It is your responsibility to confirm compatibility before purchase. We are not responsible for incompatibility you could have checked beforehand.
• Identity verification. Where required by law, you must complete identity verification (KYC) before activation. We may decline or revoke service if verification cannot be completed or appears inaccurate.
• Activation & validity. Each plan has a stated validity period, data allowance, and coverage area. Validity typically begins on activation or first network connection, as described at purchase.
• Fair use & lawful use. You must use the eSIM lawfully and in line with any fair-use policy. The eSIM is for personal use and must not be resold or used to operate a network or for unlawful activity.
• Refunds. Because eSIMs are digital and delivered on issuance, they are generally non-refundable once the eSIM profile has been delivered or activated, except where required by law or stated otherwise at purchase. See Section 7.
• Coverage. Network coverage and speeds depend on the underlying networks and your location, and are not guaranteed.

6. Bookings, pricing & payment

Prices are shown in the currency stated in the app and may include or exclude taxes and fees as indicated at checkout. We aim to keep pricing and availability accurate, but errors can occur; if a clear pricing or description error affects your order, we may cancel it and refund any amount paid.

Payment is collected through third-party payment providers. By submitting a payment, you authorize the applicable charge. A booking is confirmed only when you receive a confirmation from us or the supplier. You are responsible for any currency-conversion or bank fees charged by your payment provider.

7. Changes, cancellations & refunds

Changes, cancellations, and refunds for travel services follow the policy of the relevant supplier, shown before you book. Some bookings are non-refundable or carry change fees. eSIM purchases follow the rules in Section 5. Where we are entitled to retain a service or booking fee, that will be stated before you pay. We will process eligible refunds using your original payment method within a reasonable time.

8. Third-party suppliers

When you book a travel service, you may enter into a separate contract directly with the supplier that provides it, and that supplier’s terms (including conduct, safety, age, licensing, and cancellation rules) apply alongside these Terms. Suppliers are independent of Eddy Trip. Except to the extent required by law or where we are the direct provider, we are not responsible for the acts, omissions, quality, safety, or performance of suppliers, and any dispute about the delivery of a supplier’s service is between you and that supplier. We will reasonably assist you in resolving such issues.

9. Your responsibilities

• Travel documents. You are responsible for ensuring you hold valid passports, visas, permits, and any required documents for your trip.
• Health & insurance. You are responsible for meeting health, vaccination, and insurance requirements for your destination.
• Licensing. For vehicle rentals, you must hold a valid, accepted driving license and meet the supplier’s requirements.
• Accuracy. You must provide accurate traveler information; we are not responsible for losses caused by inaccurate details you supply.
• Compliance. You must comply with local laws at your destination.

10. Acceptable use

You agree not to: use the Platform unlawfully or fraudulently; resell or commercially exploit services except as permitted; interfere with or disrupt the Platform or its security; attempt unauthorized access; scrape, reverse-engineer, or copy the Platform except as allowed by law; upload malicious code; or infringe the rights of others. We may investigate and take action, including suspension, for any breach.

11. User content

If you submit reviews, ratings, photos, or other content, you confirm you have the right to do so and grant us a non-exclusive, worldwide, royalty-free license to use, host, display, and distribute that content in connection with the Platform. You must not submit content that is unlawful, misleading, infringing, or offensive. We may remove content that breaches these Terms.

12. Intellectual property

The Platform, including the “Eddy Trip” name, logo, software, design, and content (other than user content and supplier content), is owned by us or our licensors and protected by intellectual-property laws. We grant you a limited, personal, non-transferable, revocable license to use the app for its intended purpose. All rights not expressly granted are reserved.

13. Disclaimers

Except as expressly stated and to the fullest extent permitted by law, the Platform and services are provided “as is” and “as available,” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Platform will be uninterrupted, error-free, or secure, or that any service, supplier, network coverage, or content will meet your expectations. Nothing in these Terms excludes liability that cannot be excluded under applicable law, including consumer-protection rights you may have.

14. Limitation of liability

To the fullest extent permitted by law, Eddy Trip and its officers, employees, and partners will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising out of or relating to your use of the Platform or any service. To the fullest extent permitted by law, our total aggregate liability for any claim relating to a service is limited to the amount you paid to us for that specific service in the twelve (12) months before the event giving rise to the claim. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.

15. Indemnification

You agree to indemnify and hold harmless Eddy Trip and its partners from claims, losses, and reasonable expenses (including legal fees) arising from your breach of these Terms, your misuse of the Platform, or your violation of any law or third-party right, except to the extent caused by us.

16. Force majeure

We are not liable for any failure or delay caused by events beyond our reasonable control, including natural disasters, severe weather, epidemics or pandemics, war, civil unrest, government action, strikes, network or utility failures, or supplier failures.

17. Suspension & termination

You may stop using the Platform and delete your account at any time (see the Privacy Policy for deletion steps). We may suspend or terminate your access if you breach these Terms, if required by law, or to protect the Platform, users, or suppliers. Provisions that by their nature should survive termination (including Sections 12–15 and 18) will continue to apply.

18. Governing law & disputes

These Terms are governed by the laws of the Socialist Republic of Vietnam, without regard to conflict-of-laws rules. Subject to any mandatory consumer-protection rights available to you in your country of residence, any dispute will be submitted to the competent courts of Vietnam.

We encourage you to contact us first at legal@eddytrip.com so we can try to resolve the matter informally.

19. App store terms

If you download the app from the Apple App Store or Google Play, you also agree to that store’s terms, and the following apply:

• These Terms are between you and Eddy Trip only, not with Apple or Google, and Eddy Trip (not the store) is solely responsible for the app and its content.
• The store has no obligation to provide maintenance or support for the app.
• To the extent permitted by law, the store is not responsible for any product warranties, claims, or third-party intellectual-property claims relating to the app; handling these is Eddy Trip’s responsibility.
• You represent that you are not located in a country subject to an applicable embargo and are not on any restricted-party list, and you will use the app in compliance with applicable export and usage rules.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

20. Changes to these Terms

We may update these Terms from time to time. We will update the “Last updated” date and, for material changes, give notice in the app or by email. Your continued use of the Platform after changes take effect means you accept the updated Terms.

21. General

If any provision is found unenforceable, the rest remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. These Terms, together with the Privacy Policy and any service-specific terms shown at purchase, form the entire agreement between you and Eddy Trip regarding the Platform.
